A man or woman that does this obviously wants the best of both worlds. I advise speaking to the person up front and telling them what you want and expect. If he or she continues having an intimate relationship with the ex, you have a choice of accepting it or telling him or her goodbye. If s/he does not want to give up the ex for you, then s/he was never really capable of the type of relationship you were hoping for anyway.
